Orby Terms of Service

These terms govern your use of the Orby iOS app. By using Orby, you agree to them. If you do not agree, please do not use the app.

What Orby is

Orby measures the time you spend in social media apps you select, and represents your remaining daily allowance as a glowing orb. You may share that single percentage with friends you choose.

Accuracy

Orby's measurements come from Apple's Screen Time framework. Timing may be approximate, may lag, and may be affected by device restarts, iOS updates, or system conditions outside our control. Percentages shown for you or your friends may occasionally be delayed or out of date. Do not rely on Orby where precise measurement matters.

Your responsibilities

• You must be old enough to form a binding contract in your jurisdiction, and at least 13 years old.
• You are responsible for who you give your friend code to. Anyone with your code can send you a friend request and, once added, see your current percentage and first name.
• Do not use Orby unlawfully, or attempt to interfere with, reverse engineer, or disrupt the service or other users.
• You are responsible for the name you choose. Orby has no photo upload and no other user-generated content.

Free plan

Orby is free to use for yourself: your own orb, your own screen-time measurement, notifications, widgets, and settings. The free plan is personal only — it does not include connecting with other people. On the free plan you cannot add a friend, send or accept a friend request, or let anyone connect to your Orby using your code. Someone who enters your code will simply be told you have not activated Orby Friends.

Orby Friends subscription

Connecting with friends requires an optional auto-renewing subscription:

• Monthly — billed monthly, charged immediately. No free trial.
• Yearly — includes a 7-day free trial. After the trial ends, the yearly price is charged automatically unless you cancel beforehand.

Prices are shown in the app in your local currency. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription in your device Settings under your Apple Account. Deleting the app does not cancel your subscription. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial period.

Refunds are handled by Apple under the App Store terms; we cannot issue refunds directly.

Availability and changes

We may modify, suspend, or discontinue Orby or any feature at any time. Features that depend on Apple's iCloud, Screen Time, or App Store services may be unavailable if those services are interrupted. We may update these terms; continued use after an update constitutes acceptance.

Termination

You may stop using Orby at any time by deleting it. We may suspend or terminate access if you breach these terms.

Disclaimers and limitation of liability

Orby is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of Orby. Where liability cannot be excluded, it is limited to the amount you paid for Orby in the twelve months preceding the claim.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Governing law

These terms are governed by the laws of French Polynesia, without regard to conflict-of-law rules.
